Article 2 – Applicability

These terms and conditions apply to offers, orders and agreements via Vigenzo.nl with consumers: individuals who buy for private use.

You can read and save these terms before placing your order. The version that applied when you placed your order applies to that order.

These terms do not limit your statutory consumer rights.

Article 3 – Products and offers

Vigenzo sells clothing. For every item we provide the clearest possible information about the main characteristics, including size, colour and price.

Product photos represent the item as accurately as possible. Colour reproduction may vary slightly depending on your screen settings. This does not affect your right to an item that conforms to the agreement.

If an offer is valid for a limited time or has special conditions, we state this with the offer.

In the event of an obvious error, such as a pricing error that you should reasonably have understood to be incorrect, Vigenzo cannot be held to that error. We will inform you as soon as possible and refund any amount received if no valid agreement has been concluded.

Article 4 – Ordering and the agreement

The agreement is concluded when you accept our offer by completing your order with the designated order button.

You will receive a confirmation of your order by email.

Before completing your order, please check your details, selected items and sizes. Spot a mistake afterwards? Contact us as soon as possible at info@vigenzo.nl. We will see whether a change is still possible.

Article 5 – Prices and payment

All prices are in euros and include VAT. Any shipping costs are stated separately before you complete your order.

For the Netherlands, shipping costs are € 7.95 per order. For Belgium they are € 9.95 per order. Orders from € 150 are shipped free to both countries.

Vigenzo offers payment via iDEAL/Wero, Mastercard and Visa.

The total amount and chosen payment method are shown before you complete your order. The statutory rules on advance payment continue to apply. These terms do not oblige you to pay more than 50% of the purchase price in advance. You may voluntarily choose to pay in full in advance.

After the agreement is concluded, we do not unilaterally increase the agreed price.

Article 6 – Shipping and delivery

Vigenzo delivers in the Netherlands and Belgium via PostNL, with track and trace.

The expected delivery time from placing your order is:

  • Netherlands: 1–2 business days.
  • Belgium: 2–3 business days.

After shipping you receive a shipping confirmation with a track and trace code.

These are expected delivery times. If we know that delivery will be delayed, we will inform you as soon as possible.

If the agreed delivery time is exceeded, you may give us a reasonable additional period to deliver. If we fail to deliver within that period too, you may dissolve the agreement and you will get the amounts paid back. Where the law gives you the right to dissolve immediately, you do not need to give an additional period.

If an ordered item cannot be delivered, we will contact you. We only deliver a replacement item if you agree to it.

The risk of loss or damage during shipping lies with Vigenzo until you, or a person designated by you who is not the carrier, has received the item. A statutory exception applies if you engage a carrier yourself that was not offered by Vigenzo.

Article 7 – Right of withdrawal

You may withdraw your purchase without giving a reason within 14 days from the day after you receive your order.

Receiving items from one order in several deliveries? Then this period starts on the day after you receive the last item.

This right also applies to sale items.

Within the cooling-off period, clearly let us know that you wish to withdraw the purchase in whole or in part. You can do this via the returns button on Vigenzo.nl, by email to info@vigenzo.nl or with another unambiguous statement. You may use the model form from our shipping and returns policy, but this is not required.

After your withdrawal notification you have another 14 days to return the items. You do not need to wait for Vigenzo’s approval.

Article 8 – Handling and returning items

You may unpack and try on the clothing as you would in a shop.

Handle the items with care. Where reasonably possible, we ask you to return them with the original labels and packaging. The absence of these does not automatically void your right of return.

You are only liable for any reduction in value resulting from handling the item more than necessary to assess its nature, characteristics and fit. We may deduct this reduction in value from the amount to be refunded.

Pack your return carefully and keep the proof of postage.

The returns address is:

Vigenzo
Woensdrechthof 58
2631 LD Nootdorp
Netherlands

In the event of withdrawal, the direct return costs are at your expense. These depend on the carrier and shipping method you choose.

Article 9 – Refund on withdrawal

We refund you as soon as possible, no later than 14 days after your withdrawal notification.

We may wait until we have received the items or until you have demonstrated that you have returned them, whichever comes first.

If you withdraw the entire order, we also refund the original standard delivery costs. Extra costs for a more expensive delivery method chosen by you are not refunded. For a partial return we do not refund the original delivery costs.

We use the same means of payment you used, unless you expressly agree to another method. We do not charge any costs for the refund.

Article 10 – Exchanges

Vigenzo does not offer a direct exchange service. For a different size, colour or another item, you can return the purchase and place a new order.

This does not limit your right to replacement of an incorrectly delivered or defective item.

Article 11 – Legal guarantee

You are entitled to an item that conforms to the agreement and has the properties you may reasonably expect.

In the event of an incorrectly delivered or defective item, you can contact us at info@vigenzo.nl. Preferably state your order number and a description of the problem. A photo can help with the assessment.

If you are entitled to the legal guarantee, we provide a free solution in accordance with the applicable statutory rules. This may be repair or replacement, or a price reduction or dissolution where you are legally entitled to it. The necessary shipping and return costs are then borne by Vigenzo.

In the Netherlands, the legal guarantee has no fixed term. The duration depends on what you may reasonably expect from the item. Belgian consumers retain the protection of the Belgian legal guarantee rules, including the two-year term for new goods.

Damage arising solely from incorrect use, incorrect maintenance or normal wear and tear is not covered by the legal guarantee. The statutory rules on the burden of proof continue to apply.

The 14-day cooling-off period does not limit your guarantee rights.

Article 12 – Questions and complaints

You can send questions and complaints to info@vigenzo.nl. Describe the problem and preferably state your order number.

On business days we respond within 24 hours. If substantive handling takes more time, we will let you know the next steps and when you can expect a further response.

Vigenzo is not affiliated with a webshop quality mark or disputes committee.

Article 13 – Liability

Vigenzo is liable in accordance with the applicable statutory rules. These terms do not exclude any liability that may not be excluded by law.

A malfunction or delay does not limit your statutory right to delivery, dissolution, refund or compensation.

Article 14 – Applicable law and disputes

Dutch law applies to agreements with Vigenzo.

Do you live in Belgium as a consumer? Then this choice of law does not deprive you of the protection of mandatory consumer rules that would apply to your agreement without this choice of law.

In the event of a dispute we try to reach a solution together. You may also submit the dispute to the court that has jurisdiction under the applicable statutory rules.

Article 15 – Changes

Vigenzo may change these terms for future orders. A change does not apply retroactively to an agreement already concluded.

If a provision proves invalid or voidable, the remaining provisions continue to apply to the extent legally possible. Your statutory consumer rights are retained.
